GENERAL TERMS AND CONDITIONS OF SALE PRIVATE INDIVIDUALS/CONSUMERS

 

1.   GENERAL PROVISIONS

These general conditions are valid exclusively between the company MDI4X4 di Massimiliano  Latini  sas., with sede legale 60035 Jesi via Ancona 15 tel.3317727869 e mail info@mdi4x4.com PEC mdi4x4@legalmail.it .it codice fiscale 03039690429  p.i IT 03039690429 any person (the “Customer”) who makes online purchases on the websites WWW.MDI4X4.IT  .

These general conditions govern distance purchases, not for professional/commercial purposes, made by the Customer/consumer, in accordance with articoli 50 e ss. del D.Lgs. 6 settembre 2005, n. 206 (“Codice del Consumo”), as well as D.lgs. n. 21 del 21/02/2014.

 

2.   SUBJECT OF THE CONTRACT

The Customer purchases at a distance the tangible movable goods indicated and offered for sale by MDI4X4 di MDI4X4 di Massimiliano  Latini  sas. sui sito web  WWW.MDI4X4.IT

The Contract is concluded directly at the moment of acceptance by MDI4X4 di Massimiliano  Latini  sas. of the purchase proposal received from the Customer following the invitation to offer contained on the websites.

These general conditions of sale (“Condizioni Generali”) and, in particular, the information referred to in art. 52 of the Codice del Consumo, as provided by MDI4X4 di Massimiliano  Latini  sas during phone calls or e-mails exchanged with the Customer and reported on the Site, shall remain valid and effective until they are amended and/or supplemented by MDI4X4 MDI4X4 di Massimiliano  Latini  sas

Any changes and/or additions to the Condizioni Generali shall be effective from the date on which they are visible on the websites and shall apply to sales made from that date onward.

The latest updated version of the Condizioni Generali is the one available on the websites.

 

3.   PRICES

• All products offered on the website MDI4X4.IT    owned by the above-mentioned company MDI4X4 di Massimiliano  Latini  sas  are excluding taxes and transport .
• All products offered on the website mdi4x4.it owned by the above-mentioned company MDI4X4 di Massimiliano  Latini  sas., are presented excluding VAT (legal rate), transport is excluded
• The price of the finished product is automatically calculated at the time of the quotation request and the transport charge will be calculated only after receiving the quotation request
  • Minimum charge 15,00€

Transport cost values may be subject to change without notice.

 

4.   PURCHASE AND PAYMENT METHODS

The Contract is finalized by sending the quotation including transport costs by MDI4X4 di Massimiliano  Latini  sas. stating that the proposal formulated by the former has been accepted by entering the transport cost .

In order to be processed, the proposal must contain the Customer’s personal details, shipping address, telephone/fax/email contacts, purchase order, authorization pursuant to D.Lgs 196/2003 and the chosen payment method.

The Customer will be allowed to choose one of the following payment methods:

• bank transfer in advance by the customer who, after requesting the bank details of MDI4X4 di Latini Massimiliano, will issue and subsequently send a copy of the transfer by fax or By choosing this type of payment, the actual departure of the goods will take place only after receipt of the bank accounting showing the effective crediting of the amount to our account (usually 3/5 days);
• credit card for which a connection will be used that provides for the transmission of data over a secure line, with an encrypted connection, directly to the bank in charge of The purchaser’s data for invoicing and delivery must match those of the credit card holder.
• payment via PAYPAL 

Payment for the ordered goods no later than 15 days from the completion of the contract is a necessary condition for processing the proposal by the seller.

MDI4X4 di Latini Massimiliano. may accept or reject the proposals received at its sole discretion.

 

5.   DELIVERY OF PRODUCTS – COMPLAINTS

MDI4X4 di Massimiliano  Latini  sas  will deliver the products to the address indicated by the Customer within 30 (thirty) days from the conclusion of the Contract, unless prevented by fortuitous event and/or force majeure.

Any complaint may be sent to the following address  MDI4X4 di Massimiliano  Latini  sas, con sede legale Via Ancona 15 60035 Jesi , registered letter with acknowledgement of receipt A/R, or by PEC email to the PEC address info@mdi4x4.com PEC

If the packaging shows damage/injuries at the time of delivery, the parcel must be accepted “con riserva” in order to be able to claim directly against the carrier. If this indication is not observed by the Customer, MDI4X4 di Massimiliano  Latini  sas, will not be able to assist in obtaining reimbursement for damages occurred during shipment.

The material always travels at the risk of the Customer/principal.

 

6.   WARRANTIES AND ASSISTANCE

All products purchased remotely benefit from a contractual warranty whose duration is stated on the product sheets of the items and in any case from the legal warranty of 24 months for conformity defects, pursuant to the legislation in force protecting the Customer/consumer.

The warranty applies exclusively to the product presenting a conformity defect, provided that it has been assembled and used correctly, in compliance with its intended use and in accordance with the attached technical documentation.

In order to benefit from warranty assistance, the Customer must keep and present to MDI4X4 di Massimiliano  Latini  sas. proof of purchase for tax purposes.

The warranty does not in any case include the intervention of the technician at the Customer’s premises, but exclusively at the premises of MDI4X4 di Massimiliano  Latini  saso ove il componente “difettoso” complete with accessories and packaging must be delivered, agreeing in advance between the parties on the methods and timing of collection.

MDI4X4 di Massimiliano  Latini  sas o. will return the component to the supplier/manufacturer (or, where applicable, to the designated service center) for verification of the reported defect.

If the defect is foundMDI4X4 di Massimiliano  Latini  sas will restore and/or replace the product and, if it is no longer available, refund the price, without any charge to the Customer.

 

If no defect is found,MDI4X4 di Massimiliano  Latini  sas will inform the Customer of the reasons, and the costs of verification and restoration requested by the authorized service center, as well as the shipping costs incurred, will be charged to the Customer.

MDI4X4 di Massimiliano  Latini  sas is not responsible for any delay in carrying out repairs/replacements.

MDI4X4 di Massimiliano  Latini  sas also cannot be held responsible for any damage to property or persons that may be attributable to the use and/or incorrect assembly of the purchased components.

The description of each product contained on the Site, in the catalog or in other informational material is merely illustrative and does not constitute certification or warranty by MDI4X4 di Massimiliano  Latini  sas . regarding the actual characteristics and performance of the goods sold. For this purpose, the technical documentation of each item directly provided by the manufacturer (or alternatively reproduced by MDI4X4 di Massimiliano  Latini  sas), for the contents of which MDI4X4 di Massimiliano  Latini  sas cannot be held responsible.

 

7.   PACKAGING

Standard packaging is that provided by the respective manufacturer of the ordered goods; if not considered, MDI4X4 di Massimiliano  Latini  sas, sufficient for the protection of the goods, it shall be MDI4X4 di Massimiliano  Latini  sas itself to carry out subsequent packaging with greater protection.

Shipping costs are understood to include flat-rate packaging costs.

 

8.   CUSTOMER OBLIGATIONS

The Customer declares and guarantees:

• that he/she is a consumer as provided for in art. 3 of the Codice del Consumo;
• that he/she is of legal age;
• that the data provided by the same for the execution of the Contract are correct and

 

9.   RIGHTS OF WITHDRAWAL

The Customer has the right to withdraw from the concluded contract, without any penalty and without specifying the reason, within 10 days from receipt of the products.

The Customer may exercise the right of withdrawal, within the above term, by expressing it through a written communication to the premises of MDI4X4 di Massimiliano  Latini  sas, to be sent by registered letter with return receipt or by PEC email to the PEC address info@mdi4x4.com PEC

The Customer intending to make use of the right of withdrawal must return the products to the address indicated on the invoice, following the instructions set out therein, within 14 days from receipt of the products. Ai sensi dell’articolo 55, secondo comma, del Codice del Consumo, the Customer shall not have the right of withdrawal in the following cases:

• lack of the external packaging and/or original internal packaging;
• absence of integral elements of the product (accessories, cables, manuals, ..) or anomalies of the product itself;
• damage to the product 

The right of withdrawal does not apply in any case to customized products (printed, silk-screened, cut to size ) with wording or symbol (logo) chosen by the Customer, nor to catalog products expressly requested by the customer.

The costs of returning the products remain at the Customer’s expense.

MDI4X4 di Massimiliano  Latini  sas will refund the Customer within 30 days from the date of receipt of the products (intact and complete) the price paid.

 

10.   MANLEVA

MDI4X4 di Massimiliano  Latini  sas assumes no responsibility for service disruptions attributable to force majeure and/or fortuitous event, even where dependent on malfunctions and service disruptions of the internet network.

 

11.   PRODUCT AVAILABILITY

The availability of each product is only indicative, has no contractual character and no liability may be attributed to the seller in the event of its unavailability.

Should the Customer have purchased a product no longer available, he/she will receive the relativa nota di credito and reimbursement of the price by bank transfer without losing anything.

 

COPYRIGHTS – ACCESS TO THE SITES

The integrity of the elements of the websites, whether sound or visual, and the related technology used remain the property of MDI4X4 di Massimiliano  Latini  sas and are protected by intellectual property rights.

The Customer has the right to access the websites for consultation and making purchases; no other use is allowed, in particular commercial use of the websites and their contents.

 

13.   ENTIRETY

These general conditions of sale consist of the entirety of the clauses composing them. If one or more provisions were judged invalid by an authority having jurisdiction, the other clauses shall continue in full force and effect.

 

14.   APPLICABLE LAW AND COMPETENT JURISDICTION

These general conditions of sale are governed by Italian law.

Any dispute concerning the interpretation of these general conditions and the performance of the contract shall be submitted to the jurisdiction of the ordinary judicial authority of the Customer’s place of residence, which, if located in the national territory (I), shall apply Italian law.

 

15.   PRIVACY

Pursuant to and for the purposes of D.Lgs 196/2003, all data provided by the Customer during registration prior to purchase shall be stored by MDI4X4 di Massimiliano  Latini  sas. and used solely for the necessary tax/accounting obligations and for the execution of the concluded contract.

The Customer is expressly prohibited from providing false personal data or data of third parties during registration, as well as from carrying out double registrations.

These general conditions govern distance purchases made by the Customer for professional/commercial purposes

In order to be processed, the proposal must contain the Customer’s personal details, shipping address, telephone/fax/email contacts, purchase order, authorization pursuant to D.Lgs 196/2003 and the chosen payment method.

The Customer will be allowed to choose one of the following payment methods:

• bank transfer in advance by the customer who, after requesting the bank details of Latini Massimiliano., will issue and subsequently send a copy of the transfer or By choosing this type of payment, the actual departure of the goods will take place only after receipt of the bank accounting showing the effective crediting of the amount to our account (usually 3/5 days);
